Abstract

This work examines how identity was established for civil partnerships in the codification process in Spain and why there is an intense doctrinal controversy in this respect in Spain. Historically, as a general rule, the connection between civil partnership and legal identity did not exist. However, when they were coded, both concepts were connected, in order to try to configure their relationships in a different way. Today this can seem like an intention of hindering economic flow, because the idea that a civil partnership must function as a legal entity in order to adequately operate in the market is so rooted. In addition to studying how the identity of partnerships was established in the Civil Code, the reform initiated by the Law of Professional Partnerships, which somehow modified this topic, will be examined.
