Abstract

This work, at a first moment, approaches the free competition in the communitarian environment under the perspective of the philosophy. For in such a way, it submits the free competition to the analysis of three philosophical chains, in intention to support it as a true manifestation of freedom. In a second step, corroborated by the authority of the philosophical argument, try to demonstrate that the freedom of the companies to concur during the process of economic integration between countries is part of the structure focused on communitarian order in a market economy. In this perspective, the work analyzes Assunção and Rome Treat and concludes that the limitation policy of freedom competition by regulating rules does not deny freedom as a Treats characteristic, nor as a basic right in the integration processes.
