On the extension of the merger system as stipulated by act nº 18.046

Abstract

This paper analyzes the subjective scope that today merger operations have reached in the most modern legislations, placing them within the reach of all kinds of entities with corporate personality, public or private. Then, it discusses the situation in the Chilean legal system where, on the one hand, a scant generalization of such kind of operation is noticed and, on the other, a limited regulation which, by means of a comprehensive hermeneutic process, has been generically applied, thus avoiding special characteristics of such operations.
