Abstract
The acknowledgment in the private sector of the effectiveness of the fundamental rights opens a new dimension for the protection of workers, because it makes it possible to reconcile the social agents’ interests with the principles of a free market economy, along with the values, liberties, and guarantees stipulated in the basic rights that the Constitution ensures to all the people. Based on the above, this paper attempts to present an overview of both the scope and the projections of the ripple effect of the workers’ fundamental rights as long as these workers are regarded as persons in a corporate milieu; then it focuses on their acknowledgment in the Chilean labor law and in the Labor Office’s jurisprudence with a view to providing insights into the understanding of institutions and principles typical of the Labor Law in the present makeup of the labor world.
