Abstract
This article suggests that the relation between criminal law and criminal procedural law can be addressed from two points of view: an "interrelating" one, where interpret and law enforcer become confounded and where the courts acquire the faculty to create important laws; and another, "un-interrelating," which considers both systems inactive sections. Both points of view suggest short-term and general consequences for the relation between criminal procedural law and criminal law. Besides, and considering the "creative" work of the investigative entity, some criticisms over the Office of the Attorney General’s regulatory formulation are made.
