Las politicas de orientacion a la victima examinadas a la luz del derecho penal

Abstract

This paper presents the theses that both propose that the victim should be given a greater prominence in criminal conflict resolutions and contain the idea of returning the conflict to society. Basically, such orientations have been geared toward establishing mediation and redress procedures as a third procedure. However, some doubts may arise if these mechanisms, especially mediation, can be comprised within the area of criminal law, considering that this law addresses the potential victims rather than the real victim.
