Abstract
Abstract: The German Law does not provide for a corporate criminal liability strictu sensu. Instead, the Law allows administrative respectively “paracriminal” sanctions. A legal comparison of models of the Anglo-American legal system and concepts discussed in Spain and Latin America reveals the particularities of the German Law. Legal history shows that these peculiarities in German are based mainly on historical coincidences, not on dogmatic needs. Reforms are urgently needed.
