Abstract
This paper analyzes the effects of the bad faith incident regulated in article 169 A subsection 4 of Act 20.720. Based on a dogmatic analysis of the institution of the rejection of the discharge of the debt based on the prevention of abuse, considering the elements of the notion of abuse of the natural person, and a comparative analysis of the history of the law regarding the introduction of the rule in the Chilean legal system, the extent of the institution is determined and solutions are proposed to the problems of limitation of the relief interest of the debtor and legal uncertainty that the rule presents.
