Abstract

The main goal of this work is to determine the legal nature of the period between inquiry and trial in the Chilean Criminal process of Law -including the pre-trial hearing. It will be argued that it presents a preparatory nature. A comparative law methodology will be developed, in particular, two models of the main foreign jurisdictions will be considered: the preparatory model and the decisional model. Both models appear to be relevant to the Chilean discussion.
